1. Acceptance of Terms
These Terms of Service form a binding agreement between you and Strongwall, Inc. By using the Services, you agree to be bound by these Terms and the Privacy Policy at strongwall.ai/privacy. Continued use after updates constitutes acceptance.
2. Eligibility
You must be at least eighteen (18) years of age to use the Services. By using the Services, you represent that you meet these requirements.
3. Accounts and Access
Users authenticate with Strongwall-issued keys or credentials. Each account is for a single user and may not be shared. Strongwall cannot access or restore locally stored data.
4. Privacy and Data Practices
Use of the Services is subject to the Privacy Policy. Strongwall operates a privacy-first, zero-retention model and does not use third-party AI providers. Limited operational logs may be maintained briefly for security.
5. User Content and AI Interactions
You are responsible for your inputs. Strongwall processes data transiently and does not retain it. AI outputs are for informational use only. Strongwall is not liable for actions taken based on such content.
6. Prohibited Conduct
You agree not to interfere with operations, attempt unauthorized access, or engage in unlawful activities. Strongwall may suspend or terminate accounts for violations.
7. Service Availability
Strongwall may modify, suspend, or discontinue the Services without notice. We are not liable for unavailability or downtime.
8. Intellectual Property
All Strongwall software, designs, and trademarks remain property of Strongwall. Users retain full ownership of lawful AI-generated outputs. The Strongwall name, logo, and brand identity may not be used without written consent.
9. Payments and Subscriptions
Strongwall offers monthly ($16/month) and annual ($144/year) auto-renewable subscriptions. Fees may also be processed via Stripe or Coinbase Commerce.
Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless canceled at least 24 hours before the end of the current period.
Apple In-App Purchases: When purchased through the iOS app, payment is charged to your Apple ID account at confirmation of purchase. Subscriptions are managed and canceled through your Apple ID account settings or the Settings app on your device. See Apple's subscription management guide for details.
Cancellation: You may cancel at any time. Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused time.
All purchases are final and non-refundable except as required by applicable law. Cryptocurrency transactions are irreversible. Users are responsible for applicable taxes.
10. AI Disclaimer and Accuracy
AI outputs may contain errors or omissions. They are for informational purposes only and not professional advice. Strongwall is not liable for actions based on such outputs.
11. Limitation of Liability
Strongwall's total liability shall not exceed the lesser of one hundred dollars ($100) or the total fees paid by you in the three months preceding the claim. Strongwall is not liable for indirect or consequential damages.
12. Indemnification
You agree to indemnify and hold Strongwall harmless from any claim arising from misuse of the Services or from AI-generated content that violates third-party rights.
13. Termination
Strongwall may suspend or terminate access for violations, non-payment, or to protect system integrity. Termination does not affect rights that should survive, including ownership and indemnification.
14. Governing Law and Arbitration
These Terms are governed by Delaware law. All disputes shall be resolved through mandatory binding arbitration in Delaware under AAA commercial rules. Class actions and jury trials are waived.
15. Force Majeure
Strongwall shall not be liable for delays or failures caused by events beyond its reasonable control, including natural disasters, cyberattacks, or government actions.
16. Export Compliance
You agree to comply with all applicable U.S. export control and sanctions laws. You represent that you are not located in a jurisdiction subject to U.S. embargoes or listed on any sanctions list.
17. Severability
If any provision of these Terms is held invalid, the remaining provisions shall remain in full force and effect.
18. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Strongwall and supersede all prior agreements or representations.
19. Survival
Sections relating to ownership, disclaimers, limitations of liability, indemnification, and arbitration shall survive termination of your account or these Terms.
20. Beta or Experimental Features
Certain features may be released in beta or experimental form. Such features may not function as intended and are provided on an "as is" basis. Your use of beta features is at your own risk.
